Terms of Service

1. About these terms

These Terms of Service (“Terms”) govern your access to and use of the Mosaic & Me platform, website at mosaicandme.com, and all related services (collectively, the “Platform”). By creating an account or using the Platform, you agree to be bound by these Terms.

Mosaic & Me Ltd (“we”, “us”, “our”) is a company registered in England and Wales. Our registered office is at hello@mosaicandme.com. Our company registration number is pending.

If you do not agree to these Terms, you must not use the Platform.

2. The Platform

Mosaic & Me is a skills-first recruitment platform that connects candidates with companies through skills-based matching. The Platform enables candidates to build skills profiles (“Mosaics”) and matches them with roles posted by companies based on skills alignment, working preferences, and cultural fit.

We provide the Platform on an “as is” and “as available” basis. We may update, modify, or discontinue features at any time, with reasonable notice where practicable.

3. Eligibility and accounts

3.1 Eligibility

To use the Platform you must be at least 18 years old and have the legal capacity to enter into a binding agreement. If you are registering on behalf of a company, you confirm that you have authority to bind that organisation to these Terms.

3.2 Candidate accounts

Candidates may register for a free account. You must provide accurate and complete information during registration and keep your account details up to date.

3.3 Company accounts

Company access to the Platform is currently by invitation only. Companies require a valid invitation code to create an account. Companies may also register their interest for future access, which does not guarantee an account will be provided.

3.4 Account security

You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately at hello@mosaicandme.com if you become aware of any unauthorised use of your account. We are not liable for any loss arising from unauthorised access to your account where you have failed to keep your credentials secure.

4. Candidate obligations

As a candidate using the Platform, you agree to:

  • Provide truthful, accurate, and current information in your profile and Mosaic.
  • Not misrepresent your skills, experience, qualifications, or work history.
  • Not use the Platform for any purpose other than genuine job-seeking activities.
  • Not upload content that is defamatory, discriminatory, obscene, or otherwise unlawful.
  • Not attempt to contact companies outside the Platform’s matching and communication features for the purpose of circumventing the Platform.

5. Company obligations

As a company using the Platform, you agree to:

  • Provide accurate information about your organisation, roles, and requirements.
  • Not use candidate data obtained through the Platform for any purpose other than recruitment for the specific roles listed on the Platform.
  • Comply with all applicable employment and equality legislation, including the Equality Act 2010, when using the Platform to recruit.
  • Not share, sell, or distribute candidate profile data to third parties.
  • Respond to candidate expressions of interest in a timely and professional manner.
  • Comply with the invitation-only access terms and not share invitation codes with unauthorised parties.

6. Intellectual property

6.1 Our intellectual property

All intellectual property rights in the Platform, including its design, software, algorithms, matching technology, branding, and content (excluding user-generated content), belong to Mosaic & Me Ltd or our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Platform.

6.2 Your content

You retain ownership of any content you upload to the Platform, including profile information, skills data, and role descriptions (“Your Content”). By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, process, display, and distribute Your Content solely for the purpose of operating and improving the Platform.

6.3 AI-generated content

The Platform uses artificial intelligence to generate summaries, assessments, and matching insights based on data provided by users. AI-generated content is provided for informational purposes only and should not be relied upon as the sole basis for any hiring or career decision. We do not guarantee the accuracy of AI-generated outputs.

7. Matching and AI processing

7.1 How matching works

The Platform uses automated processes, including AI and algorithmic matching, to compare candidate skills profiles with company role requirements. Match scores and assessments are generated automatically based on the data provided by both parties.

7.2 No guarantee of outcomes

We do not guarantee that candidates will receive job offers or that companies will find suitable candidates. Match scores are indicative and do not constitute a recommendation, endorsement, or guarantee of suitability.

7.3 Automated decision-making

In accordance with UK data protection law (including the UK GDPR as amended by the Data (Use and Access) Act 2025), we inform you that the Platform uses automated processing to generate match scores and candidate assessments. These automated outputs assist but do not replace human decision-making. Companies retain full responsibility for all hiring decisions.

8. Fees and payment

8.1 Candidate access

The Platform is free for candidates.

8.2 Company access

Company pricing is set out in the agreement provided at the time of invitation. We reserve the right to change pricing with 30 days’ written notice to existing customers. Fees are exclusive of VAT unless stated otherwise.

8.3 Refunds

Fees paid are non-refundable except where required by law or expressly stated in your company agreement.

9. Data protection

We process personal data in accordance with UK data protection law, including the UK General Data Protection Regulation (“UK GDPR”), the Data Protection Act 2018, and the Data (Use and Access) Act 2025. Full details of how we collect, use, store, and protect personal data are set out in our Privacy Policy, which forms part of these Terms.

10. Limitation of liability

10.1 Exclusions

To the maximum extent permitted by law, we exclude all liability for:

  • Loss of profits, revenue, business, or anticipated savings.
  • Loss of data or corruption of data.
  • Indirect, consequential, or special losses.
  • Any loss arising from reliance on AI-generated content, match scores, or assessments.

10.2 Cap on liability

Our total aggregate liability to you under or in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the greater of (a) the fees paid by you to us in the 12 months preceding the event giving rise to the claim, or (b) one hundred pounds sterling (£100).

10.3 Nothing excluded

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded.

11. Suspension and termination

11.1 By you

You may close your account at any time by contacting us at hello@mosaicandme.com or using the account settings. Upon closure, we will delete your data in accordance with our Privacy Policy and applicable data retention obligations.

11.2 By us

We may suspend or terminate your account immediately if:

  • You breach these Terms.
  • We reasonably suspect fraudulent, abusive, or unlawful activity.
  • You provide false or misleading information.
  • We are required to do so by law.

We will give you reasonable notice before termination where practicable, except where immediate action is necessary.

11.3 Effect of termination

Upon termination, your right to access the Platform ceases immediately. Sections that by their nature should survive termination (including intellectual property, limitation of liability, and dispute resolution) will continue in force.

12. Availability and maintenance

We aim to keep the Platform available at all times but do not guarantee uninterrupted access. We may temporarily suspend the Platform for maintenance, updates, or for reasons beyond our reasonable control. We will endeavour to give advance notice of planned downtime where possible.

13. Third-party services

The Platform may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or availability of third-party services. Your use of third-party services is at your own risk and subject to their terms.

14. Changes to these terms

We may update these Terms from time to time. Material changes will be notified to you via email or through the Platform at least 14 days before they take effect. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the changes, you should stop using the Platform and close your account.

15. Complaints

If you have a complaint about the Platform or our services, please contact us at hello@mosaicandme.com. We will acknowledge your complaint within 5 working days and aim to provide a full response within 20 working days.

16. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. General provisions

17.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us in relation to your use of the Platform.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

17.3 Waiver

No failure or delay by us in exercising any right under these Terms shall operate as a waiver of that right.

17.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms to a third party, provided that such assignment does not reduce the protections available to you.
